Terms of Use

1. Acceptance of Terms

By downloading, installing, or using SRTWhisper ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. License

SRTWhisper grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Apple Media Services Terms and Conditions.

3. Description of Service

SRTWhisper is a macOS application that provides:

• On-device video speech transcription using AI (WhisperKit)
• Subtitle translation via local LLM, OpenAI API, or Ollama
• Subtitle editing, formatting, and export (SRT, VTT, ASS)
• Subtitle burning into video files

4. User Responsibilities

• You are responsible for the content you process through the App
• You must have the necessary rights to any video files you process
• You are responsible for compliance with applicable copyright laws
• You must not use the App for any illegal purpose

5. Third-Party Services

The App optionally integrates with third-party services:

• OpenAI API: Subject to OpenAI's Terms of Use. You are responsible for your own API key and usage costs.
• Ollama: Subject to Ollama's respective terms. You are responsible for your own server configuration.
• Hugging Face: AI models are downloaded from Hugging Face and subject to their respective model licenses.

6. Intellectual Property

The App and its original content, features, and functionality are owned by nonotoday and are protected by applicable intellectual property laws.

7. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that:

• Transcription or translation results will be 100% accurate
• The App will be uninterrupted or error-free
• The App will meet your specific requirements

8. Limitation of Liability

To the maximum extent permitted by law, nonotoday shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon updating this page. Your continued use of the App constitutes acceptance of the modified terms.

11. Apple EULA

This agreement is supplementary to Apple's standard End User License Agreement (EULA) for apps distributed through the Mac App Store. In case of conflict, Apple's EULA takes precedence.

12. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
